GLOBAL AI MUSIC ECOSYSTEM & UGC PLATFORM

Aiply is an Online Service Provider (OSP) providing the 'technical infrastructure (cloud hosting and network)' that enables users to post, share, and stream user-generated music, sound recordings, audio, text, and AI-collaborative works (hereinafter "User Content" or "UGC").
The Company does not pre-screen user content and assumes no liability for user-generated materials. The Company is fully protected by the 'Safe Harbor' provisions specified in the US Digital Millennium Copyright Act (DMCA 17 U.S.C. § 512), the EU Digital Services Act (DSA), and the Copyright Act of the Republic of Korea.
The Service is intended for users aged 13 or older. However, in certain jurisdictions the minimum age may be higher depending on the laws of the specific jurisdiction in which the user resides (e.g., EU GDPR). In such cases, the user must meet the statutory age of that jurisdiction. If you are under the statutory age for data protection, you must create an account with the explicit consent of a parent or legal guardian.
The copyright and intellectual property rights of the original content uploaded to the Service remain entirely with the user (or the original copyright holder). By uploading content to the platform, the user grants the Company a worldwide, non-exclusive, royalty-free license to host, store, reproduce, distribute, modify, stream, publicly perform, and promote the content.
This license generally terminates when the user deletes the content. However, the license may continue for the limited purpose of operating and maintaining the Service (e.g., CDN caching, system backups, log retention).
Except where such use is explicitly authorized by the user, the Company does not use the user's content without permission to train its own or a third party's foundational AI models or Large Language Models (LLMs).
The user bears 100% legal responsibility for any infringement of copyright or personality rights arising from all content they upload to the Service. Users legally warrant that they will not engage in the following acts:
Uploading content that clones, imitates, or synthesizes (Voice Cloning) another person's voice using AI technology without their explicit written consent.
Unauthorized use or AI separation and uploading of stems, beats, lyrics, or samples from copyrighted sound recordings without lawful clearance.
Engaging in automated scraping or data mining without the Company's permission, or manipulating play counts and asset trading volumes through view-botting.
Rightsholders claiming infringement of copyright or publicity rights may report it to the Company's Designated Copyright Agent: eyenic@naver.com. Upon receiving a valid report, the Company will take prompt action to delete or block access to the content.
Users who repeatedly infringe the rights of others may have their accounts permanently suspended without prior notice, and all assets within the platform may be forfeited.
'Points' and 'Notes' within Aiply are digital utility indicators intended to vitalize the platform. Points and Notes do not constitute securities, investment contracts, or financial instruments under any circumstances, and cannot be exported off-platform or directly exchanged for fiat currency or cryptocurrency.
The Company reserves the right, at its sole discretion, to delete inappropriate content, restrict exposure, or limit account access at any time without prior notice to maintain service stability and comply with laws.
The Company shall not be liable for indirect or incidental damages arising in connection with the user's use of the Service. In no event shall the Company's total liability exceed the greater of the total amount actually paid by you to the Company in the 12 months preceding the claim, or USD 100.
The user is obligated to fully defend and indemnify SYNAPTIVE against any claims and lawsuits arising from a breach of these Terms or the uploaded content.
These Terms shall be governed by the laws of the Republic of Korea. The exclusive court of first instance for disputes between the Company and the user shall be the Gwangju District Court of the Republic of Korea.
Users agree that disputes will be resolved individually and not as part of any class or representative action.
Aiplyは、ユーザーが生成した音楽、音源、オーディオ、テキスト、およびAIコラボレーション著作物（以下「ユーザーコンテンツ」または「UGC」）を投稿、共有、ストリーミングできる「技術的インフラ（クラウドホスティングおよびネットワーク）」を提供するオンラインサービスプロバイダー（OSP）です。
会社はユーザーコンテンツを事前に検閲せず、ユーザーが生成した資料に対していかなる法的責任も負いません (The Company does not pre-screen user content and assumes no liability for user-generated materials)。会社は、米国デジタルミレニアム著作権法（DMCA 17 U.S.C. § 512）、EUデジタルサービス法（DSA）、および大韓民国著作権法等に明記された「セーフハーバー（Safe Harbor）」規定の保護を全面的に受けます。
本サービスは、13歳以上のユーザーのみが利用することを意図しています (The Service is intended for users aged 13 or older)。ただし、ユーザーが居住する特定の管轄区域（例：欧州GDPR等）の法律により要求される最低年齢がこれより高い場合があり (In certain jurisdictions the minimum age may be higher)、その場合は該当する管轄区域の法定年齢を満たす必要があります。データ保護のための法定年齢に満たない場合、親または法定代理人の明示的な同意の下でアカウントを作成する必要があります。
ユーザーがサービスにアップロードしたオリジナルコンテンツの著作権および知的財産権は、ユーザー（または原著作権者）に完全に維持されます。ユーザーはプラットフォームにコンテンツをアップロードすることにより、会社に対し、全世界で該当コンテンツをホスティング、保存、複製、配布、修正、ストリーミング、公開実演およびプロモーションするための非独占的かつ無償の権利を付与します。
本ライセンスは原則としてユーザーがコンテンツを削除した時点で終了しますが、サービスの運営および維持（CDNキャッシュ、システムバックアップ、ログの保管など）という限定的な目的のためには合理的な期間存続する場合があります (However, the license may continue for the limited purpose of operating and maintaining the Service)。
ユーザーが明示的に承認した場合を除き (except where such use is explicitly authorized by the user)、会社はユーザーのコンテンツを自社または第三者の基盤AIモデルや大規模言語モデル（LLM）の学習に無断で使用することはありません。
ユーザーがサービスにアップロードするすべてのコンテンツの著作権、人格権侵害に関する法的責任は100%ユーザー自身にあります。ユーザーは以下の行為を行わないことを法的に保証します。
他人の明示的な書面による同意なしに、その音声をAI技術で無断複製、模倣、合成（Voice Cloning）してアップロードする行為。
適法なクリアランス（Clearance）なしに著作権のある音源のステム、ビート、歌詞、サンプルを無断で使用、またはAIで分離してアップロードする行為。
会社の許可なしに自動化されたスクレイピング（Scraping）、データマイニングを行うこと、またはビューボット（View-botting）を通じて再生数や資産取引量を操作する行為。
著作権またはパブリシティ権の侵害を主張する権利者は、会社の指定著作権代理人 (Designated Copyright Agent: eyenic@naver.com) に申告することができます。会社は適法な申告を受理した際、迅速に削除またはアクセスブロックの措置を講じます。
他人の権利を反復して侵害するユーザーは、事前の通知なしにアカウントが永久停止され、プラットフォーム内の全資産が没収される場合があります。
Aiply内の「ポイント（Point）」および「ノート（Note）」は、プラットフォーム活性化のためのデジタルユーティリティ指標です。本財貨はいかなる場合も証券、投資契約、または金融商品を構成せず (Points and Notes do not constitute securities, investment contracts, or financial instruments)、法定通貨や暗号資産として外部へ持ち出したり、直接交換することはできません。
会社は、会社の完全な裁量により (The Company reserves the right, at its sole discretion)、サービスの安定性維持および法令遵守のために、いつでも不適切なコンテンツの削除、露出の制限、またはアカウントへのアクセス制限を行う固有の権限を留保します。
会社は、ユーザーのサービス利用に関連して発生した間接的、偶発的損害について責任を負いません。いかなる場合でも、会社の総賠償責任は、当該クレーム発生前の12ヶ月間にユーザーが実際に会社に支払った総額、または100米ドル（USD 100）のいずれか大きい金額を超えないものとします。
ユーザーは、本規約の違反またはアップロードしたコンテンツに起因して発生するすべてのクレームおよび訴訟からSYNAPTIVEを完全に防御し、免責させる義務を負います。
本規約は韓国法を準拠法とし、会社とユーザー間の第一審の専属管轄裁判所は大韓民国光州地方法院とします。
ユーザーは、すべての紛争が個別的にのみ解決されなければならず、いかなる形態の集団訴訟または代表訴訟の一部としても進行されないことに明示的に同意します (Users agree that disputes will be resolved individually and not as part of any class or representative action)。
Aiply는 사용자가 생성한 음악, 음원, 오디오, 텍스트 및 AI 협업 저작물(이하 "사용자 콘텐츠" 또는 "UGC")을 게시, 공유, 스트리밍할 수 있는 '기술적 인프라(클라우드 호스팅 및 네트워크)'를 제공하는 온라인 서비스 제공자(Online Service Provider)입니다.
회사는 사용자 콘텐츠를 사전에 검열(pre-screen)하지 않으며, 사용자가 생성한 자료에 대해 어떠한 법적 책임도 지지 않습니다 (The Company does not pre-screen user content and assumes no liability for user-generated materials). 회사는 미국 디지털 밀레니엄 저작권법(DMCA 17 U.S.C. § 512), 유럽연합 디지털 서비스법(EU DSA) 및 대한민국 저작권법 등에 명시된 '안전항구(Safe Harbor)' 규정의 보호를 전면적으로 받습니다.
본 서비스는 만 13세 이상의 사용자만 이용하도록 의도되었습니다 (The Service is intended for users aged 13 or older). 단, 사용자가 거주하는 특정 관할권(예: 유럽 GDPR 등)의 법률에 따라 요구되는 최소 연령이 이보다 더 높을 수 있으며 (In certain jurisdictions the minimum age may be higher), 이 경우 해당 관할권의 법정 연령을 충족해야 합니다. 정보 보호를 위한 법정 연령에 미달하는 경우 부모 또는 법정 대리인의 명시적 동의 하에 계정을 생성해야 합니다.
사용자가 서비스에 업로드한 원본 콘텐츠의 저작권 및 지식재산권은 사용자(또는 원 저작권자)에게 온전히 유지됩니다. 사용자는 플랫폼에 콘텐츠를 업로드함으로써, 회사에 전 세계적으로 해당 콘텐츠를 호스팅, 저장, 복제, 배포, 수정, 스트리밍, 공개 실연 및 홍보할 수 있는 비독점적이고 무상인 권리를 부여합니다.
본 라이선스는 사용자가 콘텐츠를 삭제할 때 원칙적으로 종료되나, 서비스 운영 및 유지보수(CDN 캐싱, 시스템 백업, 로그 보관 등)의 제한적인 목적을 위해서는 합리적인 기간 동안 존속될 수 있습니다 (However, the license may continue for the limited purpose of operating and maintaining the Service).
사용자가 명시적으로 승인한 경우를 제외하고 (except where such use is explicitly authorized by the user), 회사는 사용자의 콘텐츠를 자사 또는 제3자의 파운데이션 AI 모델이나 대규모 언어 모델(LLM)을 학습시키는 데 무단으로 사용하지 않습니다.
사용자가 서비스에 업로드하는 모든 콘텐츠의 저작권, 인격권 침해에 대한 법적 책임은 100% 사용자 본인에게 있습니다. 사용자는 다음 행위를 하지 않을 것을 법적으로 보증합니다.
타인의 명시적 서면 동의 없이 목소리를 AI 기술로 무단 복제, 모방, 합성(Voice Cloning)하여 업로드하는 행위.
적법한 클리어런스(Clearance) 없이 저작권이 있는 음원의 스템, 비트, 가사, 샘플을 무단으로 사용하거나 AI로 분리하여 업로드하는 행위.
회사의 허가 없이 자동화된 스크래핑(Scraping), 데이터 마이닝을 하거나 뷰봇팅(View-botting)을 통해 재생 수, 자산 거래량을 조작하는 행위.
저작권 또는 퍼블리시티권 침해를 주장하는 권리자는 회사의 지정 저작권 대리인(Designated Copyright Agent: eyenic@naver.com)에게 신고할 수 있습니다. 회사는 적법한 신고 접수 시 신속하게 삭제 또는 접근 차단 조치를 취합니다.
타인의 권리를 반복적으로 침해하는 사용자는 사전 통지 없이 계정이 영구 정지되며, 플랫폼 내 모든 자산이 몰수될 수 있습니다.
Aiply 내의 '포인트(Point)' 및 '노트(Note)'는 플랫폼 활성화를 위한 디지털 유틸리티 지표입니다. 본 재화는 어떠한 경우에도 증권, 투자 계약, 또는 금융 상품을 구성하지 않으며 (Points and Notes do not constitute securities, investment contracts, or financial instruments), 법정 화폐나 암호화폐로 외부 반출 또는 직접 교환될 수 없습니다.
회사는 오직 회사의 전적인 재량에 따라 (The Company reserves the right, at its sole discretion) 서비스의 안정성 유지 및 법령 준수를 위해 언제든지 부적절한 콘텐츠를 삭제하거나, 노출을 제한하거나, 계정의 접근을 제한할 고유한 권한을 보유합니다.
회사는 사용자의 서비스 이용과 관련하여 발생한 간접적, 우발적 손해에 대해 책임지지 않습니다. 어떠한 경우에도 회사의 총 배상 책임은 해당 클레임 발생 전 12개월 동안 귀하가 회사에 실제로 지불한 총액, 또는 미화 100달러(USD 100) 중 더 큰 금액을 초과하지 않습니다.
사용자는 본 약관의 위반 또는 업로드한 콘텐츠로 인해 발생하는 모든 클레임과 소송으로부터 SYNAPTIVE를 전적으로 방어하고 면책시킬 의무를 집니다.
본 약관은 대한민국 법률을 준거법으로 하며, 회사와 사용자 간의 제1심 전속 관할 법원은 대한민국 광주지방법원으로 합니다.
사용자는 모든 분쟁이 오직 개별적으로만 해결되어야 하며, 어떠한 형태의 집단 소송이나 대표 소송의 일부로 진행되지 않음에 명시적으로 동의합니다 (Users agree that disputes will be resolved individually and not as part of any class or representative action).
